The following
additional terms and conditions apply to all CompAmerica DigiMemo sales.
DIGIMEMO
MERCHANDISE RETURN POLICY:
update effective Feb 14, 2008 --
NOTE about boxing material:
The original Blue/White DigiMemo boxing
material is PART OF THE WARRANTY and REQUIRED ON ALL RETURNS! Please do not
discard them. If they are not included in shipments under return or
warranty, CompAmerica reserves the right to deduct their cost or to refuse the
shipment, at its sole discretion. RETAIN and SHIP BACK WITH ANY RETURN:
ALL PACKING LISTS and RETAIL BLUE/WHITE packing materials and internal support
cardboards and plastics! This does not refer to any UPS or USPS Mailer
boxes or the plain brown Uline or Home Depot shipping boxes. However, do
not ship any product back in its original retail packing box alone. Always
place that box inside a UPS, USPS, Home Depot, or other plain brown or similar
shipping box with foam or air pack or newspaper (bunched) packing materials to
keep same secure. Boxes shipped "naked" (only in their retail packing box) will
be treated as if you did not include the retail packing box and materials:
deducted or refused, as those retail boxes require an outer shipping box and
packing material to properly protect the merchandise being shipped. Thank
you!
30 day return plan: Returns must reach us within
30 days to receive credit and must be insured
against loss or damage. You must contact us by phone at 908-931-1200 to register
your return beforehand, or your return package will be refused. If
purchased at the regular price: a user selectable 30 day return period applies and
a 20% Restocking Fee Applies (you receive 80% of what you paid for the product,
but do not receive Shipping and Handling back). All discount, oem and bulk sales
and international shipments are FINAL SALE ONLY.
60 day return plan (items ordered on Feb 14, 2008 or after): Returns must reach us within
60 days to receive credit and must be insured
against loss or damage. You must contact us by phone at 908-931-1200 to register
your return beforehand, or your return package will be refused. If
purchased at the regular price: a user selectable 60 day return period applies and
a 30% Restocking Fee Applies (you receive 70% of what you paid for the product,
but do not receive Shipping and Handling back). All discount, oem and bulk sales
and international shipments are FINAL SALE ONLY.
All returns must
be arranged for by Telephone contact wit us, not by email or post mail.
General (30 and 60 day return policies): Serial numbers on box and
products returned must match our records of the products we shipped you. To
receive your partial credit as described above, all return merchandise must be
either unopened or opened in original condition with no box damage and no
visible scratches or broken or missing parts. You must CALL US FIRST and
obtain authorization and verification of eligibility prior to shipping.
Return shipments must include the original retail Blue/White box for that item
and ALL OF IT'S PARTS including batteries, paper, cables, manuals, CDs, CD
sleeves, licenses, the original box, etc. If returning only one product,
this applies only to all of the parts originally shipped inside its retail box.
Bulk Orders (ordinarily shipped in one or more original 10 units per case,
larger shipping boxes) are sold on an "All Sales Final" basis. Credits are
paid as Credit Card partial refunds or PayPal "send money" requests. If a
partial refund is not possible (e.g.- it has been too long) and you need a check
sent you, use that option on the PayPal system (http://www.paypal.com),
a very secure, safe credit card and echeck processing system, and request a
"Send Money" by Paypal after opening an account there. They will issue money we
send you by a check mailed you. We do not, however we do endorse using
something like PayPal for all internet purchasing to avoid credit card fraud and
identity theft. OCR Handwriting Software: MyScript Notes, once unsealed,
is NOT RETURNABLE under any circumstances. If you are evaluating, a trial copy
is found on the DigiMemo Manager/Driver CD inside the Digimemo Box. It runs for
30 days from date of installation. Use that one until you are certain.
Separately purchased Pens
and all MyScript Notes Software are not
returnable: all sales are final on them. Products are subject to
inspection, if returned damaged or not with original box and accessories, no
credit applies. Unreturned batteries or missing
components are deducted from credits. All "on sale" units are "final sale" and may not be returned for credit. All credits are considered
store credits only unless otherwise arranged for in advance during the return
eligibility process over the phone.
Please note that the DigiMemo is rated as a personal computer and writing device
and as such is only returnable within the limits spelled out above. All
International purchases are final sale only, no merchandise returns on
international orders. DigiMemo products returned not in working order or missing
parts are subject to full or partial forfeiture of return credit.
FUEL SURCHARGE
ON U.S. Domestic Shipments: Recently, both USPS and UPS have assessed "fuel
surcharges" and moderate rate increases for deliveries inside the USA.
CompAmerica is attempting to keep its shipping fees at their current levels.
So far so good. If, however, in the not too distant future the surcharges
assessed upon us by USPS and/or UPS exceed the amount of the shipping cost we
have allocated to each product shipment, on a rare occasion a very modest
"postage due" or "excess freight" situation may give rise without prior notice
on your shipment. Note that the shippers do not give us any grace period on such
surcharges, often effecting them even after we have already shipped your order.
In those and other rare cases, such fees are the responsibility of the buyer
when we can not reasonably absorb them. You will be notified by eMail or at
delivery time in those rare situations. We apologies in advance for any
inconvenience caused by the rising price of petroleum products. We believe the
rising prices of Gas is being rationalized as "an upcoming bad Hurricane season
in the US Gulf states". Our reply to the Oil Industry is: move the
refineries to locations (or use the refineries already in such locations) where
such weather is uncommon.
WARNING: Please allow 2-5 business days for all
Standard Ground Orders to reach you inside Continental USA,
plus order processing
time of up to 1-3 business days. Occasional shipping delays can occur
within the Continental USA and elsewhere taking as long as 9
days to reach you, we can not
guarantee that delays will not occur being at the mercy of
shipping companies. Accelerated Shipping
takes only 1 business day after order processing days inside
Continental USA but if shipped late in the day could fall
over to a 2nd day due to the overnight shippers' who've changed their policies. Express and shipments valued greater than $150 may require
signature provision at your door, remaining undelivered until signature is
available. Please be aware that Order processing usually takes
AN ADDITIONAL 1-2 business
days plus: please take shipping duration of 2-4 days into
consideration. You MUST call us to make any other shipping
arrangements. International Shipment delivery time can not be
guaranteed, but normally take 1-3 days after clearing
Customs. Customs duties, taxes and fees on international
orders are buyer paid.
All International Orders with
EXCESS FREIGHT CHARGES must be paid prior to shipment: we will send you an email
if that applies.
RUSH ORDERS:
IT IS VITAL, IF YOU NEED YOUR ORDER SOONER, SUCH AS BY
GUARANTEED OVERNIGHT DELIVERY, THAT YOU CALL US
IMMEDIATELY AFTER PLACING IT. We can optimize the shipment
to meet your requirements.

DIGIMEMO
LIMITED WARRANTY POLICY (does not apply to merchandise return for credit): You
must CALL US FIRST to obtain a Return Authorization, prior to shipment.
DigiMemo clipboard computer is covered by a limited warrantee for up to 1 year
from date of purchase. Replacement for exchange requires returning it with its
original included pen, USB Cable, Batteries for Pen and DigiMemo, Manual, CD, clip -if
any, the retail "blue/white" box and the clear plastic suspension pieces, which
are all considered part of the warranty. Excess wear and tear, spills, shocks,
and abuse are not covered by this warranty. The DigiMemo must be shipped
in an OUTER BOX with 1" minimum of foam or foam pellets surrounding it, in an
outer box capable of surviving the journey, in its original Retail Box with the
plastic surround suspenders intact. Please Do Not return DigiMemo in only
it's blue/white retail box, that will void its warranty and you will have to pay
for its replacement box and any components damaged in transit. Flair II is
covered only by a 90 days limited user warranty.
All orders are contingent upon available inventory.
All deliveries are subject to potential Carrier delays and
are not guaranteed as to delivery cycle.
NOTE: all orders may require Signature at your door, as all
orders are shipped by USPS unless you call and make other
arrangements.
DIRECT CUSTOMERS. All Terms and Conditions are superseded by over the
phone and/or email quotes and terms defined in all direct sales in writing or by
email. Please consult with your sales quote and sales rep for further details.
SHIPMENTS:
Please allow 2
- 4 business days for
Ground shipments to reach you if inside Continental USA,
plus extra time to process your order. ORDER PROCESSING:
Most orders ship in 1-2 business days after receipt and
confirmation. We can not
ship on US Holidays or Sundays or on Saturday after 12:00 PM EST.
Orders over US$3500 require advance authorization. Signature confirmation is
taken at your door on all orders US$250 or over and on
all overnight and accelerated shipments due to UPS/USPS
and/or credit card regulations (call us if you require
signature waiver). Special Expedited
shipping available at extra charge, call the order center at
908-931-1200 to order overnight shipping. If you have
BULK or TIME DEPENDENT requirements, call us at 908-931-1200 to
arrange accordingly.
INTERNATIONAL:
All Sales Final.
Shipments outside the continental USA and to all APO, FPO's
are shipped ONLY by USPS Global AirMail Parcel Post or
Global Express Mail Parcel Post unless
otherwise arranged for (certain areas of the world require
different methods) and can take extra time to arrive. Extra
Fees for your area vary from country to country, we will
contact you to arrange for you to remit additional payment
if deemed necessary. Payment of EXCESS FREIGHT FEES is
mandatory prior to shipment.
NOTE: we
are not responsible for errors or delays in in-transit
shipping by the shipping companies. International orders
may require additional freight payments which will be
emailed you and are due and payable prior to shipment.
CompAmerica is not responsible for duties, taxes, insurance,
customs or customs brokerage fees, nor surcharges on freight
of any kind which must be paid directly by buyer.
EXPEDITED or
SPECIAL INTERNATIONAL SHIPPING:

you wish us to ship by DHL, UPS or Fedex, Domestic or
International AFTER PLACING YOUR ORDER, INCLUDE YOUR
PAYPAL TRANSACTION RECEIPT NUMBER.
Due to high security, some shipments to certain parts of the
world can be seriously delayed. If shipping outside
US: shipping amount is an estimate only. Additional charges might apply for some
international orders, in which event we will contact you by
email to
advise you of the extra freight charge before shipping to
your international address. Please be wary of 'brokerage'/'CUSTOMS'/'VAT'
fees on international orders, they are applied at the
discretion of the Customs Officials in your country, and are
due at YOUR door. It helps to arrange for your own broker or
to use an aggregator inside the USA.
PROHIBITED LOCATIONS:
We do not ship to
prohibited locations or to persons identified by the US Department of
Treasury/OFAC as illegal.
GENERAL:
Credit Card and cash balances due and charge backs
are subject to Collections Processing and Credit
Agency Reporting.
Confirmable addresses ONLY. RESTOCKING FEE APPLIES TO
ITEMS NOT ON SALE: 20% restocking charge applies
on all returns within 30 days, so long as the
product was not on sale at the time of purchase.
If an item is on sale at time of purchase, then ALL
ITS SALES ARE FINAL. No refunds on shipping and
handling fees. All
Sales Final on International Purchases. No
returns on MyScript Notes software or Pens purchased
separately. Damage and usage wear and tear may
be applied to return items and deducted from
reimbursement. Uninsured shipments are the
responsibility of the customer to replace if lost,
damaged or stolen. International Global Express Mail
and Priority Mail Shipments are insured only up to
$100 replacement value.
Prices subject
to change without notice. All transactions subject to the
laws of and venue of the County of Union, State of New Jersey, USA.
KEY:
"S/H" refers to "Shipping and Handling" which varies
depending upon weight, size, box requirements, etc.
"PP:S/H" also refers to
"Shipping and Handling" but incorporates additional features
available only to the Platinum Protection
Shipping Option.

this website, and by visiting and/or viewing this website, buyers and
other visitors acknowledge, accept and agree that all matters and
affairs including but not limited to those involving transactions with
and/or sales by CompAmerica and DigiMemo in all respects are subject
solely to the laws of and the legal jurisdiction of the State of New
Jersey, County of Union, USA.
